Terms of Service for Photo Revive AI

1. Acceptance of Terms
By using Photo Revive AI, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the product.
2. Use of the Product
Our product allows you to enhance, repair, and colorize photos using AI. By using the product, you confirm that:
- You own or have permission to use and edit the photos you upload.
- You will not use the product to upload illegal or copyrighted material without permission.
3. User Content
You retain all rights to the photos you upload and enhance through our product. You grant us a non-exclusive, royalty-free license to use the images only for the purpose of providing and improving the product.
4. User Accounts
4.1 Account Registration and Login
With the introduction of login functionality, you can now create or access an account through Email, Google, or Apple login.
- When registering, you must provide accurate, complete, and up-to-date information and keep it current.
- When you use third-party login (such as Google or Apple), authentication is handled directly by the respective third-party service and is subject to their privacy policy.
- We only receive necessary information (such as your email address and authentication identifiers) and do not obtain or store your passwords.
4.2 Login Credentials and Account Security
You are responsible for safeguarding your login credentials (such as passwords or third-party account access permissions) and for all activities that occur through your account.
- Do not share your account with others or use another person's account.
- We employ reasonable technical and administrative measures to ensure account security, but you are still responsible for protecting your device and login information.
4.3 Account Deletion and Data Removal
You have the right to request account deletion at any time. You may do so via the in-product settings or by sending an email to photoreviveai.service@hklavish.com.
After submitting your deletion request:
- We will verify your identity to prevent unauthorized actions;
- Once the deletion process is complete, your account and related personal data will be deleted or anonymized, except for information required to be retained by law;
- Once deleted, your account cannot be restored, nor can deleted data be recovered. If you later wish to use the product again, you must register a new account.
We may decline to immediately delete an account in the following circumstances:
- The account is involved in outstanding transactions, refunds, or legal disputes;
- Applicable laws or regulations require retention of certain information.
4.4 Account Suspension or Termination
If we detect violations of these Terms, misuse of product functions, or abnormal account activity, we reserve the right to suspend or terminate your account access.
Before termination, we will notify you in advance via email.
5. Restrictions
You agree not to:
- Attempt to access the product's source code.
- Use the product for any unlawful purpose.
- Misuse the product or harm the functionality of our services.
6. Refund Policy
We are committed to providing a great user experience. You may request a refund within 14 days of your purchase under the following conditions:
- You encounter technical issues that prevent you from using our service.
- You experience accidental duplicate billing.
- Your purchased credits or subscription features remain largely unused.
To initiate a refund, please contact our customer support team at photoreviveai.service@hklavish.com with your order details. We will process your request promptly upon verification.
7. Analytics, Session Replay, and Product Improvement
7.1 Overview
We use analytics tools, including PostHog, to understand how users interact with the Service, improve features, diagnose errors, and maintain security. Depending on your settings, jurisdiction, and product configuration, this may include Session Replay, which records interactions such as taps, navigation, and interface changes within the app or website.
7.2 Relationship to Privacy Policy
Details about what data is collected, how long it is retained, legal bases, international transfers, masking of sensitive fields, and your choices are set forth in our Privacy Policy. In the event of inconsistency between this Section and the Privacy Policy regarding personal data processing, the Privacy Policy controls.
7.3 What Session Replay May Include
Session Replay is designed for product analytics and may capture:
- Device type, operating system, and app version;
- Session identifiers and event metadata (e.g., screens viewed, buttons tapped);
- Technical logs related to errors and performance;
- Visual representations of the user interface during a session.
7.4 What We Seek to Exclude or Mask
We configure Session Replay to reduce collection of sensitive information, including by default or by design:
- Password and secure text fields;
- Payment screens processed by Apple/Google (not by us directly);
- Areas designated as non-recorded (e.g., via masking or “do not capture” controls on image upload, preview, or account settings where implemented).
Despite these measures, you should avoid entering sensitive personal data into free-text fields while using the Service. Session Replay is not intended to collect government ID numbers, financial account numbers, or health information.
7.5 Purpose and Legal Basis
We process analytics and Session Replay data to:
- Improve usability and product quality;
- Investigate bugs and security incidents;
- Understand aggregate usage patterns.
Depending on your region, we rely on your consent, legitimate interests (balanced against your rights), or other lawful bases as described in the Privacy Policy. Where consent is required, we will request it through in-app notices, cookie/consent banners, or platform settings before enabling non-essential recording.
7.6 Your Choices
- You may opt out of analytics or Session Replay where we offer an in-app toggle, system-level tracking permission, or consent withdrawal mechanism;
- You may limit ad tracking or analytics through device settings (e.g., iOS App Tracking Transparency, Android advertising ID settings) where applicable;
- Withdrawing consent does not affect processing already performed lawfully before withdrawal.
If you opt out, some features may still require minimal technical logging necessary to operate the Service securely.
7.7 Third-Party Processor
PostHog acts as our service provider / processor (as applicable) and processes data according to our instructions and its terms. We may use PostHog Cloud in regions such as the United States or European Union; cross-border transfers are described in our Privacy Policy.
7.8 No Sale of Personal Data
We do not sell your personal information collected through analytics in exchange for money. We do not use Session Replay for unrelated advertising profiling unless explicitly disclosed and permitted by law with appropriate consent.
8. Termination
We reserve the right to suspend or terminate access if we believe a user has violated these Terms.
9. Changes to the Terms
We may modify these Terms at any time. Continued use of the product after modifications means you accept the revised Terms.
